These Employer & Payment Terms (“Employer Terms”) apply to employers, recruiters, recruitment agencies, companies, organizations, and other users who use BrentJobs to publish job vacancies, search for candidates, access candidate-related services, or purchase paid services.

BrentJobs is operated by:

These Employer Terms supplement the BrentJobs Terms and Conditions and form part of the agreement between BrentJobs and the Employer.

By registering as an Employer, publishing a vacancy, purchasing a service, or otherwise using employer-related services, you agree to these Employer Terms.

1. Employer Account

Employers must provide accurate, complete, and current information when creating an account.

An Employer may be required to provide information such as:

  • legal company name;
  • registered address;
  • company registration or identification information;
  • contact person’s name;
  • email address and telephone number;
  • billing information; and
  • other information reasonably required to provide the services.

The Employer is responsible for maintaining the confidentiality of its account credentials and for all activity conducted through its account.

BrentJobs may request additional information or documentation to verify an Employer’s identity or legitimacy.

2. Employer Eligibility

Only legitimate businesses, organizations, recruiters, recruitment agencies, and authorized representatives may publish employment opportunities on BrentJobs.

The person creating or managing an Employer account confirms that they are authorized to represent the relevant company or organization.

BrentJobs reserves the right to refuse, suspend, or terminate an Employer account where the legitimacy or authorization of the Employer cannot reasonably be verified.

3. Job Advertisements

Employers are solely responsible for the content and accuracy of their job advertisements.

Each job advertisement must accurately describe, where applicable:

  • the position;
  • duties and responsibilities;
  • required qualifications and experience;
  • location;
  • working arrangements;
  • employment type;
  • salary or salary range, where required or represented;
  • benefits and conditions;
  • application requirements; and
  • any visa, work permit, language, qualification, or other eligibility requirements.

Employers must not publish false, misleading, discriminatory, fraudulent, or unlawful job advertisements.

4. Prohibited Job Advertisements

Employers must not use BrentJobs to advertise:

  • non-existent jobs;
  • fraudulent employment opportunities;
  • illegal activities;
  • pyramid or unlawful multi-level marketing schemes;
  • jobs requiring unlawful payments from candidates;
  • opportunities involving human trafficking or exploitation;
  • discriminatory employment opportunities prohibited by applicable law;
  • misleading salary or benefit information;
  • jobs that unlawfully require sensitive personal information; or
  • any opportunity that violates applicable law.

BrentJobs may remove or reject any advertisement that it reasonably believes violates these Employer Terms or applicable law.

5. Employer Responsibility for Recruitment

BrentJobs provides a technology platform for connecting employers and candidates.

The Employer remains solely responsible for:

  • recruitment decisions;
  • interviews;
  • selection procedures;
  • employment offers;
  • employment contracts;
  • salaries and benefits;
  • work permits and immigration requirements;
  • compliance with employment legislation; and
  • the employment relationship with any candidate.

BrentJobs does not become a party to any employment relationship established between an Employer and a candidate.

6. Candidate Information

Employers may receive access to candidate information through BrentJobs depending on the services and functionality used.

Employers shall process candidate personal data only for legitimate employment and recruitment purposes and in accordance with applicable data protection legislation.

Employers must:

  • use candidate information only for legitimate recruitment purposes;
  • maintain appropriate security measures;
  • restrict access to authorized personnel;
  • not sell candidate information;
  • not disclose candidate information unlawfully;
  • not retain candidate information longer than necessary; and
  • comply with applicable data protection obligations.

Where the Employer independently determines the purposes and means of processing candidate personal data, the Employer may act as an independent data controller and is responsible for complying with its own legal obligations.

7. Employer Communications

Employers must not use candidate information obtained through BrentJobs for unrelated marketing, unsolicited advertising, or other purposes not reasonably connected with recruitment unless the Employer has an appropriate legal basis and the necessary permissions.

8. Paid Services

BrentJobs may offer paid employer services, which may include:

  • featured job advertisements;
  • promoted job advertisements;
  • extended job advertisement visibility;
  • candidate search services;
  • access to candidate databases;
  • employer subscriptions;
  • recruitment packages;
  • additional employer tools; and
  • other services introduced by BrentJobs from time to time.

The applicable price, duration, features, and conditions will be displayed before the purchase is completed.

9. Prices and Taxes

Prices displayed by BrentJobs may be stated in USD.

Unless expressly stated otherwise, prices include applicable VAT and other taxes.

The Employer is responsible for any taxes, duties, or charges that may apply to its purchase under applicable law.

10. Payment

Payment may be made through the payment methods made available by BrentJobs or its authorized payment service providers.

The Employer authorizes BrentJobs or its payment provider to process the payment for the selected service.

BrentJobs does not store complete payment card details where payment processing is handled by an independent payment service provider, unless expressly stated otherwise.

Payment information may be processed by third-party payment providers in accordance with their own terms and privacy policies.

11. Subscriptions and Automatic Renewal

Where a service is offered as a recurring subscription, the applicable subscription period, price, renewal terms, and cancellation procedure will be clearly presented before purchase.

Unless expressly stated otherwise, subscriptions will not automatically renew unless the Employer has been informed of and agreed to automatic renewal.

12. Job Advertisement Duration

Each paid job advertisement will remain active for the period specified at the time of purchase.

After the applicable period expires, BrentJobs may deactivate or archive the advertisement.

BrentJobs does not guarantee a minimum number of applicants, views, applications, interviews, or hires.

13. Refunds

Refunds are subject to the applicable service terms displayed at the time of purchase and mandatory rights under applicable law.

Unless otherwise required by law, fees may be non-refundable after a paid service has been activated or delivered.

If a technical failure attributable to BrentJobs prevents a paid service from being delivered, BrentJobs may, at its discretion and subject to applicable law:

  • restore the service;
  • extend the service period;
  • provide an equivalent service; or
  • issue an appropriate refund.

14. Cancellation

Employers may cancel services in accordance with the cancellation procedure provided for the relevant service.

Cancellation of a subscription does not necessarily result in a refund for a period that has already been paid for, unless required by applicable law or expressly stated otherwise.

15. Advertisement Review and Removal

BrentJobs reserves the right to review, reject, edit, suspend, or remove any job advertisement or Employer account where reasonably necessary.

Reasons may include:

  • violation of these Employer Terms;
  • violation of applicable law;
  • suspected fraud;
  • misleading information;
  • complaints from candidates;
  • security concerns;
  • reputational risk;
  • misuse of candidate information; or
  • other legitimate operational or legal reasons.

Where reasonably practicable, BrentJobs may notify the Employer of the reason for removal or suspension.

16. Employer Verification

BrentJobs may perform reasonable verification procedures, including requesting company information, registration details, contact information, or other documentation.

Verification does not constitute a guarantee by BrentJobs that an Employer is financially sound, trustworthy, or suitable for any particular candidate.

17. Intellectual Property

The Employer grants BrentJobs a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, distribute, and otherwise use the Employer’s job advertisements, company name, logo, trademarks, and related content solely as reasonably necessary to provide, promote, and operate BrentJobs.

The Employer confirms that it has the necessary rights and permissions to provide such content to BrentJobs.

18. Employer Indemnification

To the extent permitted by applicable law, the Employer agrees to indemnify and hold harmless BrentJobs and Drushtvo za trgovija i uslugi MINKOV GLOBAL SERVIS DOOEL Skopje from claims, losses, liabilities, costs, and expenses arising from:

  • the Employer’s job advertisements;
  • violation of applicable employment laws;
  • violation of data protection laws;
  • misuse of candidate information;
  • infringement of third-party rights;
  • fraudulent or misleading recruitment activities; or
  • breach of these Employer Terms.

19. Account Suspension and Termination

BrentJobs may suspend or terminate an Employer account where there are reasonable grounds to believe that the Employer:

  • has breached these Employer Terms;
  • has engaged in fraudulent activity;
  • has published unlawful or misleading vacancies;
  • has misused candidate information;
  • has failed to make required payments; or
  • presents a material security or legal risk.

Termination does not affect payment obligations or other rights and obligations that accrued before termination.

20. No Guarantee of Recruitment Results

BrentJobs does not guarantee:

  • a particular number of applications;
  • candidate quality;
  • candidate availability;
  • interviews;
  • employment offers;
  • successful recruitment;
  • employee retention; or
  • any particular business result.

21. Changes to Services and Prices

BrentJobs may introduce, modify, suspend, or discontinue employer services.

Prices and service packages may also change from time to time.

Changes will not affect already purchased services unless otherwise permitted by applicable law or agreed with the Employer.

22. Payment Disputes

If an Employer believes that a payment has been processed incorrectly, the Employer should contact BrentJobs promptly using the contact details below.

The Employer should provide sufficient information to identify the relevant transaction without unnecessarily sending sensitive payment information.

23. Governing Law

These Employer Terms shall be governed by the laws of the Republic of North Macedonia, unless mandatory law provides otherwise.

Any dispute arising from or relating to these Employer Terms shall be subject to the competent courts of the Republic of North Macedonia, unless mandatory law provides otherwise.
